These Terms should be read alongside our Privacy Policy and Cookie Policy, which also apply to your use of the Website.

Placing an Order

A contract for the purchase of a Product is created as follows:

  • You select the Product(s) and complete the checkout process.
  • By confirming your order, you agree to purchase the Product(s).
  • Payment is taken via your chosen payment method.
  • We will confirm acceptance of your order via email (“Order Confirmation Email”), which makes the agreement legally binding.

We reserve the right to cancel or reject any order for reasons including, but not limited to:

  • Product unavailability.
  • Payment authorisation failure.
  • Pricing or product description errors.
  • Orders that breach these Terms or include prohibited content (see Section 4).

If a Product is discontinued or becomes unavailable after you have placed an order, we will notify you as soon as reasonably practicable and offer a full refund or, where possible, a suitable alternative.

Products and Pricing

We make reasonable efforts to ensure that product images and descriptions are accurate. However, small variations may occur.

Prices are listed in GBP and include any applicable taxes, unless stated otherwise. Delivery charges are additional and displayed at checkout.

In the event of a pricing error, we will notify you of the correct price before completing your order. We are not obliged to provide Products at an incorrect price if the error is obvious.

Personalisation and Content

If you order personalised Products, you are responsible for ensuring all details are correct before placing the order.

Uploaded images must meet our technical requirements (e.g., JPEG or PNG format). We cannot guarantee quality for low-resolution uploads.

You must not submit content that:

  • Violates copyright or intellectual property rights.
  • Is unlawful, defamatory, offensive, threatening, or discriminatory.
  • Contains personal data of third parties without consent.
  • Misrepresents identity or impersonates another person.

Delivery

Delivery costs and estimated times are shown at checkout.

Delivery dates are estimates and may be affected by factors beyond our control, such as weather or shipping delays.

You are responsible for any additional customs, import duties, or taxes in your country.

Changing or Cancelling Orders

Non-personalised Products: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the Product without giving a reason. To exercise this right, please contact us at hello@momeo.co.uk with your order number.

Personalised Products: Because personalised Products are made to your specification, they are exempt from the 14-day cancellation right under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013. Orders for personalised Products cannot be cancelled or changed once production has begun. You will be clearly informed of this exemption at checkout before you confirm your order.

We are not responsible for mistakes made by customers, including errors in text, images, or delivery details.

Refunds and Returns

We will offer a refund or replacement if Products arrive damaged or defective. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

Non-personalised Products may be returned within 30 days of receipt in their original condition for a full refund. You are responsible for the cost of returning the item unless it is faulty.

Refunds will be processed within 14 days of receiving the returned Product or evidence of damage. Refunds will be issued to the original payment method.

We do not accept returns for personalised Products due to change of mind, as set out in Section 6.2.

Payment

Payment is accepted via the methods displayed at checkout.

Payment will be processed once your order is confirmed.

All details you provide must be accurate and valid at the time of purchase.

Promotional Codes and Gift Vouchers

Promotional codes are subject to any specific terms stated at the time of issue. Unless otherwise stated, codes are single-use, cannot be combined with other offers, and have no cash value.

Gift vouchers, where offered, are valid for 12 months from the date of issue unless stated otherwise. They are non-refundable and non-transferable for cash.

We reserve the right to withdraw or amend any promotional offer at any time without notice.

All content on this Website, including designs, images, text, and graphics, is owned by or licensed to Momeo.

You may not copy, distribute, create derivative works, or commercially exploit our content without prior written permission.

Our Website may contain links to third-party sites. We do not control, endorse, or accept liability for the content or availability of these sites.

Liability

We are not liable for indirect or consequential losses, including lost income, business, profits, or data.

Our total liability to you in respect of any order shall not exceed the total price paid by you for that order.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Any matter for which it would be unlawful to exclude or limit liability.

Nothing in these Terms affects your statutory rights as a consumer.

Risk and Title

Risk of loss passes to you on delivery.

Ownership passes to you only once full payment has been received.

We may terminate your access to the Website if you breach these Terms or fail to make payment.

We are not liable for delays or failure to deliver caused by events beyond our reasonable control, including natural disasters, strikes, or shipping issues.

We expect polite and respectful communication. Abuse, threats, or inappropriate language may prevent us from responding.

Under UK GDPR, you have the right to: access the personal data we hold about you; request correction of inaccurate data; request deletion of your data (subject to legal obligations); object to or restrict certain processing; request data portability; and withdraw consent at any time where consent is the basis for processing.

Photo Retention Policy

Photos uploaded to Momeo will be retained for a limited period depending on usage:

  • Photos not used in designs or orders will be deleted after 3 months.
  • Photos used in saved designs will be deleted after 3 months of inactivity.
  • Photos used in orders will be deleted after 2 years.

We retain photos used in orders on the basis of legitimate interest, to allow us to handle any post-purchase queries, complaints, or reprints. Photos not associated with orders are retained on the basis of contract performance to enable you to complete your design.

You may request early deletion of your uploaded photos at any time by contacting us at hello@momeo.co.uk. Please note that if photos are deleted before an order is fulfilled, we may be unable to complete your order.

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to an alternative dispute resolution (ADR) provider.

Nothing in this section affects your right to bring legal proceedings.

These Terms and all orders are governed by the laws of England and Wales.

Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
